The transit of goods protected by patent
A patent grants the owner the right to prohibit goods protected by patent from being transported through Switzerland’s territory. However, this only applies if the patent owner can also prohibit these goods being imported into the destination country. If there is concrete evidence of the existence of a patent infringement in Switzerland and in the country of destination, the patent owner can request border measures by customs authorities with regard to the goods in transit (Interpretation of the Patents Act).
